ADA Title I: The Interactive Process (General MCLE)

About the Program:
Title I of the Americans with Disabilities Act [ADA] protects employees with disabilities from workplace discrimination. The law requires that when a disclosure of disability is made by an employee, the employer is required to engage in an “interactive process” with the employee to determine the best solution to provide an equal employment opportunity. Often, employers do not know what triggers the interactive process and where to begin. In this session, we will learn about the interactive process, the legal framework of the interactive process, and the circumstances that lead to a breakdown in the interactive process.
Learning Objectives
Participants will learn:
- The ADA definition of disability.
- The rights and responsibilities employees and employers have in the accommodation process.
- The legal framework established by the Equal Employment Opportunity Commission (EEOC) for the interactive process.
- The steps to take when the interactive process breaks down.
About the Speaker:
Barry Whaley, M.S., is a Director and Principal Investigator at the Burton Blatt Institute, Syracuse University. His current projects are the Southeast ADA Center, The Council on Access and Mobility Technical Assistance Center Project, the Mid-Atlantic Youth and Self-Advocacy Project, and the Inclusive Public Space Project. For forty-four years he has worked toward equitable access for people with disabilities in our country and worldwide. His research has been published in peer-reviewed journals, including The Journal of Vocational Rehabilitation, Laws, and the Journal of Forensic Science & Addiction Research. His current research examines the impact of race and disability on three ADA-related issues: 1) employment, 2) access to digital technology, 3) long and short-term poverty. Mr. Whaley is qualified in federal district court to give expert testimony on applicable guidance and industry standards for accommodating people with disabilities in the workplace.
Mandatory Continuing Legal Education credits (MCLE): One hour of General Participatory MCLE credit. The SDLL is a State of California approved MCLE provider. We are not approved in other States. For California MCLE credit, attorneys must enter their State Bar number when registering. Attorneys from other states, enter your State Bar number and State abbreviation.
