L.C., finding that undue institutionalization is discrimination under the ADA. Although the facts in Olmstead focused on providing community services to adults with disabilities living in state-operated institutions, the decision’s “most integrated setting” concept has been applied to a wide range of contexts, including employment, education and the criminal legal system. This session will review the Olmstead decision along with the subsequent court decisions, settlement agreements and Department of Justice Guidance.
